An Act dissolving the Hampshire County Regional Housing Authority and incorporating its functions into the Northampton Housing Authority.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding section 3A of chapter 121B of the General Laws or any other general or special law, rule or regulation to the contrary, the Hampshire county regional housing authority, established by chapter 419 of the acts of 1976, shall be dissolved and shall not be continued as a body corporate after the effective date of this act. All of the Hampshire county regional housing authority property, monies and personal and real property interests, powers and obligations shall be transferred to the Northampton housing authority. No approval from the department of housing and community development or any other state agency shall be necessary to effect the same.

SECTION 2. (a) Upon the effective date of this act, the following land of the Hampshire county regional housing authority shall be transferred and conveyed, and shall be vested in, the Northampton housing authority:

(i) in the town of Cummington; the land described in deeds to the Hampshire county regional housing authority dated July 22, 1980 and recorded in the Hampshire district registry of deeds in book 02172 , page 339; October 8, 1981 and recorded in the Hampshire district registry of deeds in Book 02247, page 340; October 8, 1981 and recorded in the Hampshire district registry of deeds in book 02247, page 341; and May 22, 2003 and recorded in the Hampshire district registry of deeds in book 07210 page 306, and the property known as Hillside Terrace, located at 37 Main street, Cummington; and

(ii) in the town of Huntington; the land described in deeds to the Hampshire county regional housing authority dated July 28, 1980 and recorded in the Hampshire district registry of deeds in book 02173, page 214; September 17, 1981 and recorded in the Hampshire district registry of deeds in book 02244, page 304; September 17, 1981 and recorded in the Hampshire district registry of deeds in book 02244 page 305; October 1, 1981 and recorded in the Hampshire district registry of deeds in book 02247 page 20; December 8, 1982 and recorded in the Hampshire district registry of deeds in book 02316 page 313; April 11, 1986 and recorded in the Hampshire district registry of deeds in book 02702 page 311; October 16, 2008 and recorded in the Hampshire district registry of deeds in book 09620 page 271; and October 16, 2008 and recorded in the Hampshire district registry of deeds in book 09620 page 277, the properties known as Hamblin Court located at 23 East Main street, the houses located at 12 East Main street and 20 Pine street, Huntington.

(b) The Northampton housing authority may execute and deliver a certificate in a form suitable for recording referencing the passage of this act along with a copy of said act and the register of deeds for Hampshire county shall accept the same for recording and make a marginal reference thereto upon the record of all applicable deeds for real property heretofore owned by the Hampshire regional housing authority, as provided in summary format by the Northampton housing authority. The land court shall also accept said certificate and a copy of this act for the purposes of issuing a certificate of title to the Northampton housing authority for any registered land heretofore owned by the Hampshire regional housing authority.

SECTION 3. All members of the Hampshire county regional housing authority immediately prior to the effective date of this act shall immediately transfer all files, legal and financial records or other materials belonging to the Hampshire county regional housing authority to the Northampton housing authority. Such files, records and materials shall include any such items held by consultants or legal counsel on behalf of the Hampshire county regional housing authority, without reservation.

SECTION 4. If any provision of this act conflicts with any provisions of any general or special law, state agency regulations or guidelines, the provisions of this act shall govern.
