Amendment #447 to H4600

Medically Necessary Restrictive Settings

Mr. Rogers of Norwood moves to amend the bill in section 2, in items 5920-2000 and 5920-2010, by adding the following: “Provided further, that, notwithstanding the provisions of 115 CMR 2.01 or any general or special law to the contrary, the department shall authorize settings or modes of services that are more restrictive if an individual’s primary care physician certifies in writing to the department that such settings or modes of service are medically necessary for such individual”.
