AN ACT AUTHORIZING THE TOWN OF HANCOCK TO CONTINUE THE EMPLOYMENT OF FIREFIGHTERS AND THE POLICE CHIEF.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the firefighters and police chief of the town of Hancock may continue in such positions until the age of 70 or their non-reappointment or termination, whichever occurs first; provided, however, that they are mentally and physically capable of performing the duties of such positions. The selectmen of the town of Hancock may require them to be examined by an impartial physician to determine such capability. Upon retirement, such firefighters and police chief shall receive a superannuation retirement allowance equal to that which they would have been entitled had they retired upon reaching the age of 65.

SECTION 2. This act shall not entitle any firefighter or police chief to remain in the service to the town of Hancock if otherwise removed or suspended from office in accordance with applicable laws, rules and regulations.

SECTION 3. This act shall take effect upon its passage.
