To the Honorable Senate and House of Representatives:
Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating
The
Town of Sherborn’s Annual Town Election Held On May 12, 2009.”
Senator Brown, Representative
Linsky
, and the Sherborn Board of Selectmen have asked that this legislation be filed to validate the town’s annual election held on May 12, 2009. The town lacks authority to proceed in matters authorized by the town election, including obtaining bond money for certain projects. Accordingly, absent this legislation the town would be required to hold a costly special election.
To save the town of Sherborn from the expense of conducting another election, I urge your early and favorable consideration of this bill.

An Act VALIDATING THE TOWN OF SHERBORN
’
S ANNUAL TOWN ELECTION HELD ON MAY 12, 2009.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
Notwithstanding any general or special law or bylaw to the contrary, all actions, votes and proceedings taken by the Town of Sherborn at its annual town election held on May 12, 2009, are hereby ratified, validated, approved and confirmed in all respects, notwithstanding any defect or omission in the posting of the warrant of the election.
SECTION 2.
This act shall take effect upon its passage.
