To the Honorable Senate and House of Representatives:

              Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Authorizing The Town Of Plymouth To Conduct A Referendum Election On January 19, 2010.” 

              Senate President Murray, Representatives deMacedo and Calter and the Plymouth board of selectmen have requested that I file this legislation to allow the town to hold a special election on January 19, 2010, the same date as the scheduled special state election for United States Senator.  Absent this legislation, the town charter requires the town to hold a special election in late December.  The special election would cost the town approximately $26 ,000, which would further strain the town’s budget in these difficult economic times.

Accordingly, I urge your early and favorable consideration of this bill.

An Act Authorizing The Town Of Plymouth To Conduct A Referendum Election On January 19, 2010.


 

              Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1.               Notwithstanding s ection 6-3 of chapter 5 of the town of Plymouth’s charter or any other general or special law, by-law or charter provision to the contrary, the town of Plymouth may hold a referendum election on January, 19, 2010.  

SECTION 2. This act shall take effect u pon its passage.
