To the Honorable Senat e and House of Representatives:
Pursuant to Section 5 of Article 63 of the Amendments to the Constitution, I am today signing House 4800, “An Act Making Appropriations for the Fiscal Year 2011 for the Maintenance of the Departments, Boards, Commissions, Institutions and Certain Activities of the Commonwealth, for Interest, Sinking Fund and Serial Bond Requirements and for Certain Permanent Improvements,” and returning certain portions to you for reconsideration.
Like nearly every other state in the nation, we continue to face unprecedented fiscal challenges brought on by a global economic recession. Since the fiscal crisis began two years ago, my Administration and the Legislature have worked together to close a cumulative budget gap of $12.5 billion. We have made painful cuts and implemented cost-saving reforms and efficiencies, eliminated 2,600 state jobs, and asked employees to contribute through higher health care contributions and wage cuts. These actions and continued proactive budget man agement have allowed the Commonwealth to maintain its stable, AA bond rating throughout the unprecedented downturn.
We are beginning to see signs of economic recovery. The economy has added jobs in each of the last four months. Tax revenues reflecting curr ent economic performance continue to outperform expectations. And business confidence remains high. However, a full recovery will take time, and we will continue to exercise fiscal leadership by making the tough choices necessary to maintain a balanced bud get while protecting to the extent possible the core functions of government upon which residents rely.
The $27.6 billion Fiscal Year 2011 budget I am signing today protects critical public safety services and continues to support our landmark health refor m. This budget is fiscally responsible and, for the second year in a row, it reduces the structural deficit, cutting it by 56% since FY09 when the recession began.
Along with the budget I am signing today, I am filing supplemental Fiscal Year 2011 legislat ion requesting funding necessary to preserve core operations of the Department of Corrections and the State Police. These funds will help prevent prison closings and increased levels of overcrowding and will avert the elimination of special gang and drug p olice units.
In developing our budgets for Fiscal Year 2011, we assumed the Commonwealth would receive up to $687 million in additional federal stimulus funds. This assumption was based on actions in Washington, DC over the last few months where both branches of Congre ss had passed an extension of enhanced federal reimbursement for Medicaid spending (FMAP) in separate bills and where President Obama included the funds in his budget proposal. Based on this action at the federal level, 29 other states also included additi onal FMAP in their own spending plans.
After the state Legislature’s passage of its final budget, actions taken by the U.S. Senate made clear that we can no longer be assured that we will receive the additional federal stimulus funds and that if we do, th at they will be at the same level we had budgeted for.
While my original budget proposal reflected my commitment to Local Aid, Chapter 70 education funding, Higher Education and safety net programs, the budget I am signing today reduces funding for these a nd other important programs – reductions that cannot be avoided without the federal stimulus funding. This budget will have real and painful impacts for people and communities across the Commonwealth.
The budget I am signing today includes more than $457 million in vetoes to manage the gap created by Congress’ failure to act in the best interest of states across the nation. Although the Legislature responsibly made the expenditure of much of this funding contingent on Congress’s provision of additional sti mulus funding, events in Washington since then have led me to conclude that we no longer have a basis for budgeting these funds. I will, however, continue to advocate for approval in Washington, and, in that event, I will submit a supplemental budget to re store funding to critical programs and services.
I am pleased to sign several important reforms in this budget, including dedication of excess capital gains revenue to our Stabilization Fund, tax credit transparency, some steps toward pension and probation reform, and prohibiting state agencies and authorities from using state funds for lobbying. With respect to that last reform, I interpret “state funds” as referring to all funds of state agencies and authorities which they are authorized to receive and e xpend by virtue of the powers granted to them by the Commonwealth pursuant to their enabling statutes.
Without the extension of FMAP, the conference report eliminates health care coverage for 24,000 legal immigrants living and working in Massachusetts. I am calling on members of my Administration and the Commonwealth Connector to develop a plan using available resources and savings initiatives that will be able to extend coverage for those residents currently enrolled in the Bridge Program for at least the next six months. If Congress approves additional federal stimulus aid, those residents would be covered for the remainder of the fiscal year.
Therefore:
· I am reducing appropriation amounts in items of section 2 and 2E of House 4800 enumerated in Attachment A of this message by the amount and for the reasons set forth in that Attachment;
· I am disapproving, or striking wording in, items of section 2 and 2E of House 4800 also set forth in Attachment A, for the reasons set forth in that Attachment;
· I am disapproving those sections of House 4800 itemized in Attachment B of this message for the reasons set forth in that Attachment; and
· Pursuant to Article LVI, as amended by Article XC, Section 3 of the Amendments to the Constitution of the Commonwealt h, I am returning sections 11, 26, 58, 116A, 118, 120, 129, 130, 159, 176 and 179 with recommendations for amendment. My reasons for doing so and the recommended amendments are set forth in separate letters dated today which are included with this message as Attachments C to L, inclusive.
I approve the remainder of this Act.

"; and provided further, that upon receipt of a written certification by the secretary of administration and finance, addressed to the chairs of the house and senate committees on ways and means and the comptroller of the commonwealth, that legislation extending the commonwealth’s eligibility for an enhanced federal medical assistance percentage pursuant to the American Recovery and Reinvestment Act of 2009, Public Law 111-5, has been duly enacted and signed into law by the President of the United States or that the federal government has otherwise obligated itself to authorize the continuation of the enhanced federal medical assistance percentage applied to certain expenditures by the commonwealth during fiscal year 2011, not less than $100,000 shall be allocated for the purposes of offering a no-cost method to schools and districts for professional development to build the skills of all staff members, including but not limited to, educators, administrators, school nurses, cafeteria workers, custodians, bus drivers, athletic coaches, advisors to extracurricular activities and paraprofessionals to prevent, identify and respond to bullying; provided further, that the content of such professional development shall include, but not be limited to: developmentally appropriate strategies to prevent bullying incidents; developmentally appropriate strategies for immediate, effective interventions to stop bullying incidents; information regarding the complex interaction and power differential that may take place between and among a perpetrator, victim and witnesses to the bullying; research findings on bullying, including information about specific categories of students who have been shown to be particularly at risk for bullying in the school environment; information on the incidence and nature of cyber-bullying; and internet safety issues as they relate to cyber-bullying; and provided further that the no-cost method may also include a train-the-trainer model, so-called, with demonstrated success"
