An Act increasing the yearly amount of pension as part of the accidental death benefits provided to Suzanne E. Fiske, the widow of David B. Fiske, an employee of the town of Plainville.

 

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
 

SECTION 1. Notwithstanding section 9 of chapter 32 of the General Laws, or any other general or special law to the contrary, and in order to promote the public good, the Norfolk county retirement board shall pay to Suzanne E. Fiske, the widow of David B. Fiske, an employee of the department of public works in the town of Plainville, as part of the accidental death benefit pursuant to said section 9 of said chapter 32, a yearly amount of pension equal to 80 per cent of the annual rate of regular compensation of David B. Fiske on the date such injury was sustained or such hazard was undergone, or equal to 80 per cent of the average annual rate of David B Fiske’s regular compensation for the 12-month period for which he last received regular compensation immediately preceding the date of his death, whichever is greater; provided, however, that any amount received pursuant to section 31 of chapter 152 of the General Laws shall be offset against any such pension payable in accordance with section 14 of said section 32. This act shall not affect any other benefits, including but not limited to accidental death benefits, that Suzanne E. Fiske or any other eligible beneficiaries are otherwise entitled to pursuant to said chapter 32 or any other general or special law.
