An Act relative to the tethering of dogs outside. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Section 174E of chapter 140 of the General Laws, is hereby amended by striking out, in subsection (a), after the word “owner’s”, the word “guardian’s”. SECTION 2. Section 174E of chapter 140 in further amended by striking out, in subsection (i) after the word “exercise”, the words “with a dimension of at least 100 square feet”, and inserting in place thereof the words “with a dimension of at least 50 square feet for dogs weighing up to 30 lbs and a dimension of 100 square feet for dogs weighing 31 lbs or more;” SECTION 3. Section 174E of Chapter 40 is further amended by striking out, in subsection (2), the words “electronically fenced”. SECTION 4. Section 174E of chapter 140 of the General Laws, is further amended by striking out, in subsection (v), after the word “owner’s”, the word “guardian’s”. SECTION 5. Section 174E of Chapter 40 is further amended by inserting at the end of subsection (e), after the word “dog”, the words “and for sledding dogs.” SECTION 6. Section 174E of Chapter 40 is further amended by inserting after subsection (g) the following subsection: (h) In addition to animal control officers, this section may be enforced by Massachusetts Society for the Prevention of Cruelty to Animals and Animal Rescue League of Boston officers appointed under section 57 of Chapter 22C. |
