An Act relative to criminal offender information . Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: SECTION 1. Section 172 of Chapter 6 of the General Laws as appearing in the 2010 Official Edition is hereby amended by inserting the following after the word “duties”, in line 149, the following:- “which duties for a police department shall include the screening of applications of individuals for paid or volunteer positions with such department” SECTION 2. Section 172 of Chapter 6 of the General Laws is hereby amended by inserting after subsection (n) the following subsection:- (o) Notwithstanding any other provision of this section or any other general or special law to the contrary, at any time during the application process a police department may require an applicant for a paid or volunteer position with such department to disclose all criminal offender record information, and the department need not reveal to such applicant what criminal offender record information it has obtained unless and until it bases its decision not to hire or not to allow such person to volunteer. SECTION 3: Section 4 of Chapter 151B of the General Laws as appearing in the 2010 Official Edition is hereby amended by inserting after the word “employer,” in line 370 the following:- “other than a police department” SECTION 4: Section 4 of Chapter 151B of the General Laws as appearing in the 2010 Official Edition is hereby amended by inserting after the word “employer,” in line 408 the following:- “other than a police department” |
