10/19/2009 T o t h e H o n o r a b l e S e n a t e a n d H o u s e o f R e p r e s e n t a t i v e s : Pursuant to the provisions of Article II, Section 8, Paragraph 1, Clause (2) of the Amendments to the Constitution, as amended by Article LXXXIX, I am filing for your consideration the attached legislation entitled, “An Act Validating The Actions Taken At The Annual Town Election Held In The Town Of Plympton .” Senate President Murray, Representative Calter and the Town of Plympton board of selectmen have requested that I file this legislation to validate the May 16, 2009, annual town election and all actions taken pursuant to the election. Absent this legislation, the town would have to hold a special town election, which would further strain the town’s budget and unnecessarily delay eliminating any potential challenges to the school committee’s governance. An Act VALIDATING THE ACTIONS TAKEN AT THE ANNUAL TOWN ELECTION HELD IN THE TOWN OF PLYMPTON.
Be it enacted by the Senate and House of Representatives in General Court assembled, and
by the authority of the same, as follows:
Notwithstanding the provisions of section 10 of chapter 39, and section 64 of chapter 54, of the general laws, or of any other general or special law to the contrary, the votes taken by the town of Plympton at its May 16, 2009 annual town election, and all actions taken pursuant thereto, are hereby ratified, validated and confirmed, notwithstanding any defect or omission with regard to the warrant for the election as it relates to the office of school committee member for a term of 1 year. SECTION 2. This act shall take effect upon its passage. |
