Amendment #118 to H3400

High Government Payer MLR and Limited Network Waiver

[Sponsors] Mr. Mariano of Quincy moves to amend the bill by adding the following section:

SECTION. Section 29(d) of chapter 288 of the General Laws, as appearing in the 2008 Official Edition, is amended by adding the following sentence: “The commissioner shall have discretion to apply waivers to the presumptive disapproval process requirements under section 29 to carriers who receive 80% or more of its income from government programs.”

Section 32(a) of chapter 288 of the General Laws, as appearing in the 2008 Official Edition, is amended by adding the following sentence: “The commissioner shall have discretion to apply waivers to the presumptive disapproval process requirements under section 32 to carriers who receive 80% or more of its income from government programs.”

Section 33(a) of chapter 288 of the General Laws, as appearing in the 2008 Official Edition, is amended by adding the following sentence: “The commissioner shall have discretion to apply waivers to the presumptive disapproval process requirements under section 33 to carriers who receive 80% or more of its income from government programs.”
