Amendment #215 to H4860

Qualified Immunity

Mr. Coppinger of Boston moves to amend the bill, as amended, in Section 29, by striking out the word “consider” in line 267 and inserting in place therefore the following:- be motivated by;

 

in Section 29, by striking out in its entirety lines 812-814 and inserting in place thereof the following:-

(ii) took an action or actions under the color of law that were motivated by bias on the basis of race, ethnicity, sex, gender identity, sexual orientation, religion, mental or physical disability, immigration status or socioeconomic or professional level;

 

in Section 32, by striking out the word “decertification” in line 1028 and inserting in place thereof the following:-  revocation of the certification;

 

in Section 32 by inserting after the words “pursuant to” in line 1029 the following:- subsection (b)(ii) of

 

in Section 32 by striking out the phrase “shall be immune from” in line 1032 and inserting in place thereof the following:-

may invoke the defense of qualified immunity

 

in Section 32 by striking out the word “decertification” in line 1034 and inserting in place thereof the following:- revocation of the certification

 

in Section 32 by striking out the word “grant” in line 1036 and inserting in place thereof the following:- allow the defense of qualified

 

and in Section 32 by striking out the word “or” in line 1040 and inserting in place thereof the following:- and
