Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
The deputy commissioner of capital planning and operations acting for and on behalf of the commonwealth is hereby authorized to acquire by eminent domain, by purchase or otherwise, the hereinafter described parcel of public land located in the town of Wareham and presently being used for park and recreation purposes by said town and to divert this land from its present use to a highway use in conjunction with the replacement of the Nickerson Bridge, so-called.
Subsequent to the completion of said bridge replacement the deputy commissioner of capital planning and operations is authorized to convey said parcel, by deed approved as to form by the Attorney General, to the town of Wareham for highway purposes.
The land to be acquired and diverted is shown on a plan of land entitled "Plan of Parcel of Land To Be Acquired from the Town of Wareham by The Commonwealth of Massachusetts Department of Public Works," Scale 1" =40', prepared by Vollmer Associates," which plan is to be kept on file with the chief engineer of said department. Said land is more particularly described as follows:-
PARCEL 11-1-T. Beginning at a point on said line of route 6, extending thence, along said line of highway north 77<=-05'-17" east, 129 feet to a point; thence leaving said line with the Wareham River supposed to be owned by "owner unknown" running south 22<=-54'-20" east, 17.26 feet to a point; thence turning and running south 77<=-05'-17" west, 30.00 feet to a point; thence turning and running north 12<=-54'-43" west, 15.00 feet to a point; thence turning and running south 77<=-05'-17" west, 100.59 feet to a point; thence running along a curb to the left having a radius of 25.00 feet, 51.36 feet to a point on said line of Main Street; thence turning and running north 40<=-37'-40" west, 2.25 feet to a point; thence running along a curve to the right having a radius of 25.00 feet a distance of 51.36 feet to the point of beginning on said line of Route 6. Containing 770 square feet of land more or less.
