CHAPTER 541 AN ACT FURTHER REGULATING THE PROCEDURE FOR JUDICIAL APPEAL OF CERTAIN DISPUTES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Subparagraph (c) of paragraph (1) of section 39Q of chapter 30 of the General Laws, as amended by chapter 240 of the acts of 1987, is hereby further amended by striking out the first sentence and inserting in place thereof the following sentence:- Within twenty-one calendar days of the receipt of a written decision or of the failure to issue a decision as stated in the preceding subparagraph, any aggrieved party may file a notice of claim for an adjudicatory hearing with the division of hearing officers or the aggrieved party may file an action directly in a court of competent jurisdiction and shall serve copies thereof upon all other parties in the form and manner prescribed by the rules governing the conduct of adjudicatory proceedings of the division of hearing officers.
