Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Chapter 81 of the General Laws is hereby amended by inserting after section 8, as appearing in the 1988 Official Edition, the following section:-

Section 8A. Every contract for engineering survey services awarded by the department shall be awarded to the lowest responsible and eligible bidder on the basis of competitive sealed bids publicly opened and read forthwith upon expiration of the time for filing thereof; provided, however, that the department may reject any and all bids if it is in the public interest to do so.

For purposes of this section, the term "lowest responsible and eligible bidder" shall have the same meaning as is set forth in paragraph (c) of section thirty-nine M of chapter thirty.
