Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, the Massachusetts Water Resources Authority, acting by and through its board of directors, is hereby authorized to relocate all or portions of the water line easement laid out by a taking by the commonwealth, dated May 14, 1897 and recorded with Suffolk county registry of deeds in Book 2441, Page 586.
SECTION 2. Such relocation shall be for the purpose of permitting the site of the Commonwealth Armory, so-called, at 899-925 Commonwealth avenue, in the city of Boston, to be more efficiently used for building purposes, and the cost of such relocation shall not be borne by the Authority.
SECTION 3. The location of and equipment within the relocated water line easement shall provide for the passage of water in the same or greater volume and as conveniently as does the present location and equipment.
SECTION 4. The Authority may effect such relocation by means of an exchange of locations by gift, grant, release or taking; provided, however, that such exchange shall be at no cost to the Authority.
SECTION 5. When the new location has been established by the recording with the Suffolk county registry of deeds of a suitable instrument or instruments and plan or plans executed by the Authority, all rights of the commonwealth and agencies of the commonwealth within that portion of the present location which has been relocated pursuant to this act shall be extinguished forever.
SECTION 6. This act shall take effect upon its passage.
