Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, Richard Berkenbush, chief of the call fire department and chief of police in the town of West Newbury, is hereby authorized to continue in such positions until and including November thirtieth, nineteen hundred and ninety; provided, however, that he is mentally and physically capable of performing the duties of his offices or positions; and provided, further, that he shall not serve in any event in such positions subsequent to November thirtieth, nineteen hundred and eighty-nine unless and until he shall have been examined, at his own expense, by an impartial physician designated by the Essex county retirement board to determine such capability. No further deductions shall be made from the regular compensation of said Richard Berkenbush under the provisions of chapter thirty-two of the General Laws for service in said positions subsequent to said November thirtieth, nineteen hundred and eighty-nine, and upon retirement from said positions said Richard Berkenbush shall receive a superannuation retirement allowance equal to that to which he would have been entitled had he retired on said date.
SECTION 2. This act shall take effect on November thirtieth, nineteen hundred and eighty-nine.
