CHAPTER 610 AN ACT FURTHER REGULATING THE DEPARTMENT OF PUBLIC HEALTH.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 46 of the General Laws is hereby amended by striking out section 20, as appearing in the 1988 Official Edition, and inserting in place thereof the following section:-

Section 20. Records of birth and death previously held by the superintendent of Tewksbury Hospital shall be transferred to the town clerk of Tewksbury. No certified copies of these records shall be issued by the superintendent of Tewksbury Hospital.

SECTION 2. Section ten of chapter one hundred and eleven of the General Laws is hereby repealed.

SECTION 3. Section fourteen of said chapter one hundred and eleven is hereby repealed.

SECTION 4. Said chapter 111 is hereby amended by inserting after section 69K, as appearing in the 1988 Official Edition, the following section:-

Section 69L. The commissioner shall establish rules for the control, movement and parking of vehicles on the lands within the charge of the department or the various institutions under its jurisdiction, and shall provide reasonable penalties for the violation of said rules. The commissioner may authorize the towing of vehicles parked in violation of said rules, and the owner of a vehicle which is towed shall be liable, in addition to the penalty for such violation, for the charge for removal and storage of the vehicle. Citations for violation of any rule established pursuant to this section may be issued by special police officers appointed pursuant to section ten C of chapter one hundred and forty-seven, local and county law enforcement personnel and the state police.

SECTION 5. Chapter 138 of the General Laws is hereby amended by striking out section 37, as appearing in the 1988 Official Edition, and inserting in place thereof the following section:-

Section 37. A certificate shall accompany each sample of beverages sent for analysis by an officer to the department of public health stating from whom the beverages were seized, the date of the seizure and the name and residence of the officer who seized said beverages. Said department shall note upon said certificate the date of the receipt and the analysis of said alcoholic beverages and the percentage of the alcohol or the composition and quality of said beverages, as the case may be, as required by section thirty-six on a form prescribed by said department of public health.
