CHAPTER 640 AN ACT AUTHORIZING THE CITY OF MEDFORD TO ISSUE AN INNHOLDER'S LICENSE FOR THE SALE OF ALCOHOLIC BEVERAGES TO THE TRUSTEES OF CC&F MYSTIC VALLEY I TRUST.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Notwithstanding the provisions of chapter one hundred and thirty-eight of the General Laws or any vote cast in the city of Medford pursuant to chapter five hundred and ninety-five of the acts of nineteen hundred and seventy-seven or any other general or special law, or any rule or regulation of the city of Medford to the contrary, said licensing authority is hereby authorized, subject to the approval of the alcoholic beverage control commission established under section forty-three of chapter six of the General Laws, to issue from time to time to an innholder duly licensed under chapter one hundred and forty of the General Laws to conduct a hotel, a license in accordance with section twelve of said chapter one hundred and thirty-eight for the sale of all alcoholic beverages on all days of the week, to be drunk on the premises shown as Lot 38 on a plan entitled "Mystic Center, Definitive Subdivision Plan of Land in Medford, Massachusetts." dated the tenth day of August, nineteen hundred and eighty-eight, revised on the twenty-ninth day of September, nineteen hundred and eighty-eight, on file with the Medford Community Development Board, and filed with the Land Court as Land Court Plan Number 24580-P, to the trustees of CC&F Mystic Valley I Trust under Declaration of Trust dated the twenty-third day of June nineteen hundred and eighty-nine, registered with the Middlesex South Registry District of the Land Court as Document number 802115; provided, however, that said licensing authority may not approve the transfer of said license to any person, organization or corporation other than said trustees or to such other person, organization or corporation which is approved by said licensing authority for use on said lot 38 only; and provided further that the issuing of this license shall reduce by one any increase in licenses issued under the provisions of said section seventeen.

Any license granted hereunder may be exercised only in the dining room or dining rooms and in such other public rooms or areas of the hotel as certified by said licensing authority and as said authority may deem reasonable and proper, and approve in writing. Such sales may also be made to registered guests occupying private rooms in the hotel and on outdoor patios, decks and in other public areas which are part of the hotel operation, if approved by said licensing authority. Except as set forth above, sales of alcoholic beverages may not be made on any other portion of said Lot 38.

There shall be no minimum seating capacity of any room, cocktail lounge, outdoor patio or deck, or other public area in the hotel in which alcoholic beverages are served pursuant to a license granted hereunder, nor shall there be any requirement that service of food be required in all areas so licensed. The licensing authority shall not require, as a condition to the issuing of a license hereunder, that parking be provided for the licensed establishment other than such parking as is required by applicable zoning requirements.

Except as expressly provided herein to the contrary, said licenses shall be subject to all the provisions of said chapter one hundred and thirty-eight.
