CHAPTER 72 AN ACT FURTHER REGULATING THE MASHPEE WATER DISTRICT.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 6 of chapter 136 of the acts of 1987 is hereby amended by striking out the second paragraph and inserting in place thereof the following paragraph:-

For such periods as the board of water commissioners may request, the assessors of the town of Mashpee shall be the district assessors. During such periods, the town assessors shall receive such salary for their services as district assessors as shall be agreed upon by the district water commissioners. All district assessments shall be committed to the district tax collector, who shall collect said tax in the manner provided by law for the collection of town taxes and who shall deposit the proceeds thereof with the district treasurer for the use and benefit of said district. For such periods as the district water commissioners may request, the town tax collector shall be the district tax collector. During such periods, the town tax collector shall receive such salary for services as district tax collector as shall be agreed upon by the district water commissioners. Nothing contained herein shall be construed to limit the authority of the district to hire its own assessors or tax collector and to pay for same from the district's revenues. Any costs incurred by either the assessors or the tax collector of the town of Mashpee in performing services hereunder shall be paid for by the district unless otherwise provided under any intermunicipal agreement between the town and the district.

SECTION 2. Notwithstanding the provisions of any general or special law to the contrary, the Mashpee Water District may, by vote at a special or annual district meeting called within one hundred and twenty days of the effective date of this act, provide for the levy of special assessments to recover the whole or part of the cost incurred by the town of Mashpee and assumed by the Mashpee Water District for laying pipes in the Tri-Town Circle/Horseshoe Bend Way area of the town of Mashpee for the conveyance or distribution of water to inhabitants of said area, in accordance with the provisions of sections forty-two G, forty-two H and forty-two I of chapter forty of the General Laws.

SECTION 3. Notwithstanding the provisions of any general or special law to the contrary, the town of Mashpee, by vote at a town meeting, may provide for the payment to Cape Harbor Development Corporation of the sum not to exceed one hundred fifty-two thousand two hundred fifty dollars and eighty cents as reimbursement for the cost of construction of a municipal well and testing on land owned by the town and to use for this purpose all or any part of the debt authorized pursuant to the unanimous vote approving Article 24 of the July twenty-seventh, nineteen hundred and eighty-seven Mashpee special town meeting as subsequently approved by ballot question 16 of the Mashpee special election of July twenty-eighth, nineteen hundred and eighty-seven.

SECTION 4. Notwithstanding the provisions of any general or special law to the contrary, the town of Mashpee is authorized to pay to the Mashpee Water District a sum of money to remediate the ground water contamination in the Ashers' Path/Summerwood areas and to use for this purpose all or any part of the debt authorized pursuant to the unanimous vote approving Article 24 of the July twenty-seventh, nineteen hundred and eighty-seven Mashpee special town meeting as subsequently approved by ballot question 16 of the Mashpee special election of July twenty-eighth, nineteen hundred and eighty-seven.

SECTION 5. This act shall take effect upon its passage.
