CHAPTER 84 AN ACT AUTHORIZING THE TOWN OF SUDBURY TO RELEASE A CERTAIN CONSERVATION RESTRICTION.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The town of Sudbury, acting by and through its board of selectmen is hereby authorized, subject to the approval of the secretary of environmental affairs pursuant to the provisions of section thirty-two of chapter one hundred and eighty-four of the General Laws, to release the conservation restriction and walkway easement granted to said town by the Cooperative Bank of Concord by instruments dated May twenty-third and May twenty-sixth, nineteen hundred and eighty-three, recorded in the southern district registry of deeds in the county of Middlesex in Book 15351, Page 240 and Book 15074, Page 366 to the extent shown as "Area Z" on a plan entitled "Plan of Easement in Sudbury, Massachusetts", prepared for the town of Sudbury, "Scale 1"=40', dated March, 1987 and revised June 9, 1987 by Charles A. Perkins Co., Inc. Civil Engineers & Surveyors, numbered Plan No. S-5023", and recorded or to be recorded with the southern district registry of deeds in the county of Middlesex.

In consideration for such release David M. and Mary M. Shahian shall grant to said town a recordable conservation restriction on that portion of the above described parcel shown as area "Y" on said plan for the protection of the natural and watershed resources of said town. Said restriction shall be administered by the conservation commission of said town under the provisions of section eight C of chapter forty of the General Laws.

In further consideration, said David M. and Mary M. Shahian grant said town an easement to pass and repass on foot only. Said easement is shown on the above described plan as the "proposed pedestrian walkway easement" and "Easement A".

SECTION 2. This act shall take effect upon its passage.
