CHAPTER 126 AN ACT AUTHORIZING THE DIVISION OF CAPITAL PLANNING AND OPERATIONS TO SELL AND CONVEY CERTAIN LAND IN THE TOWN OF HARWICH.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The deputy director of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey to the Edgewood Trust an easement in land located in the town of Harwich for agricultural purposes. Upon such terms and conditions as the division of capital planning and operations shall prescribe in consultation with the department of environmental management.

Said parcel is bounded and described as follows:-

Easement B.

Beginning at a point on baseline station 1790 + 15.91 said point being 91.91 feet southerly from the baseline P.C. station 1789 + 24.

Thence, S63< - 15' - 38"E, a distance of 25.00 feet to a point;

Thence, a distance of 30.09 feet along a curve to the left having a radius of 1885.08 feet to a point,

Thence, N63< - 15' - 38"W, a distance of 50.00 feet to a point;

Thence, S26< - 44' - 22"W, a distance of 12.00 feet to a point;

Thence, N63< - 15' - 38"W, a distance of 15.45 feet to a point;

Thence, a distance of 42.13 feet along a curve to the right, having a radius of 1951.33 feet, to a point;

Thence, S63< - 15' - 38"E, a distance of 41.35 feet, to the point of beginning.

Aforesaid Easement B containing an area of 2,185 square feet, more or less.

Easement A.

Beginning at a point on baseline station 1791 + 15.78;

Thence, S78< - 36' - 31"E, a distance of 25.19 feet to a point;

Thence, a distance of 20.15 feet along a curve to the left having a radius of 1885.08 feet, to a point;

Thence, N78< - 36' - 31"W, a distance of 50.32 feet to a point;

Thence, a distance of 20.14 feet along a curve to the right having a radius of 1935.08 feet, to a point;

Thence, S78< - 36' - 31"E, a distance of 25.19 feet to the point of beginning.

Said easements are shown on a plan entitled "Easement Plan for Edgewood Trust in Harwich, Massachusetts, by G.A.F. Engineering Inc., South Carver, MA, 02366; Scale 1" = 40', September 11, 1989".

SECTION 2. In consideration for said conveyance provided in section one the commonwealth may receive monetary compensation as determined by independent appraiser or a parcel of land of equal or greater value and importance for conservation purposes.

The costs for any such appraisals and surveys shall be paid by the Edgewood Trust.
