Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Subsection (1) of section 2 of chapter 539 of the acts of 1989 is hereby amended by striking out the first paragraph and inserting in place thereof the following paragraph:-
The general administration of the management and fiscal and prudential affairs of the sewer and water systems of the city known as the town of Methuen shall, except as otherwise provided herein, be vested in the Methuen sewer and water commission. Said commission shall consist of not less than five members as determined by the town council. Said members shall be appointed by the town manager subject to the approval of the town council in accordance with the provisions of section 3-2 (b) of Article 3 of the charter of said city for terms of three years beginning the first secular day of January or until their successors are qualified.
SECTION 2. Said subsection (1) of said section 2 of said chapter 539 is hereby further amended by striking out the fourth paragraph and inserting in place thereof the following paragraph:-
A majority of the members of the commission shall constitute a quorum and, except as otherwise provided by law or charter, a motion may be passed by the affirmative vote of a majority of those present.
SECTION 3. Section 5 of said chapter 539 is hereby amended by striking out the second paragraph and inserting in place thereof the following paragraph:-
The town council shall, by ordinance, establish the terms of the first appointees to said commission; provided, however, that said terms shall be arranged so that one-third of their number, or as near thereto as possible, shall be appointed annually.
