CHAPTER 206 AN ACT AUTHORIZING THE DEPUTY COMMISSIONER OF THE DIVISION OF CAPITAL PLANNING AND OPERATIONS TO ACQUIRE CERTAIN PARCELS OF LAND IN THE TOWN OF PLYMOUTH FOR HIGHWAY PURPOSES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, to acquire by eminent domain, purchase or otherwise, two parcels of park land in the town of Plymouth, said parcels being owned by the town of Plymouth and to transfer the care, custody and control of said parcels of land to the department of public works for highway purposes.

Said parcels of land are more particularly described as follows:-

PARCEL 3-12-T: A certain parcel of land situated at the northwesterly corner of the intersection of Main Street Extension and Sandwich Street, Plymouth, Plymouth County, Massachusetts, bounded and described as follows:-

Beginning at a point in the southwesterly sideline of Main Street Extension. Said point being S 50<=-33'-26" E, one hundred six and fifty-eight hundredths (106.58) feet distant from an angle point in said sideline. Said point also marks a point of curvature at the sideline rounding onto Sandwich Street; thence running southeasterly, southerly and southwesterly along a curve to the right having a radius of twenty-three (23.00) feet, an arc distance of fifty and thirty-two hundredths (50.32) feet to a point of tangency in the northerly sideline of Sandwich Street; thence running S 74<=-47'-54" W, five and eighty-one hundredths (5.81) feet to a point in said northerly sideline of Sandwich Street; thence turning and running northeasterly, northerly and northwesterly along a curve to the left having a radius of twenty-six (26.00) feet, an arc distance of fifty-six and eighty-eight hundredths (56.88) feet by the remaining land of the town of Plymouth to a point of tangency in said southwesterly sideline of Main Street Extension; thence turning and running S 50<=-33'-26" E, five and eighty-one hundredths (5.81) feet to the point of beginning.

The last four (4) courses describe Parcel No. 3-12-T which contains an area of one hundred and twenty-four (124) square feet.

For a more particular description of the above - described, reference is made to a plan entitled, "Plan of land in Plymouth, Massachusetts, Owned by the Town of Plymouth to be taken for Highway Purposes", dated April 23, 1990, and prepared by the Plymouth Department of Public Works - Engineering Division.

Being a portion of Parcel P-8 as described in a deed from the Plymouth redevelopment authority to the inhabitants of the town of Plymouth, recorded at the Plymouth county registry of deeds in book 3589, pages 197-200.

PARCEL 3-21-T: A certain parcel of land situated on the northeasterly side of Sandwich Street, Plymouth, Plymouth County, Massachusetts, bounded and described as follows:-

Beginning at a point in the northeasterly sideline of Sandwich Street. Said point being S 48<=-30'-43" E, one hundred twenty-five and forty-four hundredths (125.44) feet distant from an angle point in said sideline; thence turning and running N 32<=12'-00" E, seventy-six hundredths (0.76) feet to a point in the proposed sideline of said Sandwich Street; thence turning and running S 48<=-51'-15" E, fifty-one and seventy-eight hundredths (51.78) feet in said proposed sideline and by the remaining land of the town of Plymouth to a point; thence turning and running S 29<=-04'-03" W, one and eight hundredths (1.08) feet to a point in said northeasterly sideline of Sandwich Street. Said point being N 48<=-30'-43" W, one hundred eleven and twelve hundredths (111.12) feet distant from the center of a stone bound situated in said northeasterly sideline of Sandwich Street; thence turning and running N 48<=-30'-43" W, fifty-one and eighty-nine hundredths (51.89) feet in said northeasterly sideline of Sandwich Street to the point of beginning.

The last four (4) courses describe Parcel No. 3-21-T which contains an area of forty-seven (47) square feet.

For a more particular description of the above - described, reference is made of a plan entitled, "Plan of Land in Plymouth, Massachusetts, Owned by the Town of Plymouth to be Taken for Highway Purposes", dated April 25, 1990, and prepared by the Plymouth Department of Public Works - Engineering Division.

Being a portion of the land described in a deed from Albert E. Manter to the town of Plymouth, recorded at the Plymouth county registry of deeds in book 1466, page 279.

SECTION 2. This act shall take effect upon its passage.
