Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to convey by deed, approved as to form by the attorney general, an easement over a certain parcel of land located in the city of Boston presently under the control of said division for the purposes of constructing, reconstructing, installing, replacing, repairing, adding to, renewing, inspecting, maintaining, operating and abandoning in place steel pipes and conduits comprising a three hundred and forty-five thousand volt electric transmission line and conduits with fiber optic cables to the Boston Edison Company and subject to such additional terms and conditions as said deputy commissioner or a successor state agency may prescribe. The consideration for such easement shall be the fair market value of said easement as determined by an independent appraisal. Said consideration to be agreed upon by said Boston Edison Company and said deputy commissioner or a successor state agency. The cost of appraisals, surveys and other expenses shall be paid by said Boston Edison Company. Said parcel and easement are shown on a plan, entitled "Easement Plan in Boston, MA" drawn by Survey Engineers of Boston and dated February 9, 1987 on file with Boston Edison Company, to be recorded in the Suffolk county registry of deeds.
SECTION 2. This act shall take effect upon its passage.
