Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The deputy commissioner of the division of capital planning and operations, acting for and on behalf of the commonwealth, is hereby authorized, subject to the provisions of sections forty E to forty J of chapter seven of the General Laws, to acquire by eminent domain, by purchase, or otherwise, certain hereinafter described parcels of public land in the city of Attleboro and to transfer the care, custody, and control of said parcels to the department of public works for highway purposes in conjunction with the alterations of Pond street for the Pond street bridge project, so-called.

SECTION 2. The deputy commissioner of the division of capital planning and operations, acting for and on behalf of the commonwealth, is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to acquire by eminent domain, by purchase, or otherwise, a permanent drainage easement in conjunction with highway improvements to Pond street necessitated by the reconstruction of the aforesaid Pond street bridge, so-called on a certain parcel of land in the city of Attleboro.

SECTION 3. The parcels of land described in sections one and two are shown on a plan of land entitled: "Plan of Parcel in the City of Attleboro Bristol County Taken for Highway Purposes by the Department of Public Works dated March 23, 1989 Scale: 100 feet to the inch, prepared by Purcell Associates, Boston, Mass.," which plan shall be kept on file with the chief engineer of said department of public works.
