Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The city of Northampton, acting by and through the conservation commission of said city, is hereby authorized to grant a permanent easement through a certain parcel of conservation land, under the care and control of said conservation commission to install, construct, reconstruct, replace and repair, maintain, use, operate and inspect water lines across and upon the land in said city of Northampton. Said parcel is bounded and described as follows:
BEGINNING at a point on the westerly side of Crestview Drive, said point being the southeasterly corner of land now or formerly of Kevin and Kathy Monahan, said point also being the northerly corner of Lot 53 as shown on a Plan of Land entitled, "Partial Revision of Brookwood Estates, Northampton, Mass. for Kay Vee Realty Co., Inc.", Smith Associates, Scale: 40' = 1", dated March, 1978 and recorded in the Hampshire registry of deeds in the county of Hampshire in Planbook 108, Page 16.
THENCE S. 45< 23' 43" E. along said Crestview Drive a distance of 30.00 feet to an unmonumented point;
THENCE S. 33< 42' 05" W. along other land of the Northampton conservation commission a distance of 101.84 feet to an unmonumented point;
THENCE N. 45< 23' 43" W. along land now or formerly of Gordon E. Murphy a distance of 49.26 feet to an unmonumented point;
THENCE N. 44< 36' 17" E. along land now or formerly of Kevin and Kathy Monahan a distance of 100.00 feet to an unmonumented point and the place of beginning.
Being the same parcel described as Water Line Easement No. 2 on a plan of land entitled "Definitive Subdivision of Land in Northampton, Massachusetts prepared for Gordon E. Murphy" dated October 11, 1988, as revised, prepared by Almer Huntley, Jr. & Associates, Inc., of Northampton, Massachusetts, being the "Stone Ridge Pond" Subdivision approved by the Northampton Planning Board on June 22, 1989 and recorded in the registry of deeds in the county of Hampshire, Plan Book 165, Pages 31-38.
Such easement is granted for the purpose of installation, construction, reconstruction, replacement and repair, maintenance, use, operation and inspection of water lines serving the "Stone Ridge Pond" Subdivision as approved by the Northampton Planning Board on June 22, 1989 and recorded in the registry of deeds in the county of Hampshire, Plan Book 165, Pages 31-38.
SECTION 2. This act shall take effect upon its passage.
