CHAPTER 469 AN ACT RELATIVE TO THE CLEANUP OF TOXIC WASTE.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 2 of chapter 21E of the General Laws is hereby amended by striking out the definition of "Priority disposal site", as appearing in the 1988 Official Edition, and inserting in place thereof the following definition:-

"Priority disposal site", a disposal site which constitutes a substantial hazard to health, safety, public welfare or the environment and a disposal site located within five hundred feet of a building being used as a school.

SECTION 2. Subsection (f) of section 3A of said chapter 21E, as so appearing, is hereby amended by striking out the fifth paragraph and inserting in place thereof the following paragraph:-

The order in which priority sites are addressed under this subsection shall be determined in accordance with the Massachusetts Contingency Plan; provided, however, that such priority sites shall include a disposal site located within five hundred feet of a school building.
