Session Laws

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 1 of chapter 7 of the General Laws, as appearing in the 1988 Official Edition, is hereby amended by inserting after the word "administration", in line 3, the words, "except that in sections 38A> through 43H the word 'commissioner' shall mean 'commissioner of capital planning and operations'".

SECTION 2. Section 4A of said chapter 7, as most recently amended by section 1 of chapter 731 of the acts of 1989, is hereby further amended by inserting after the words "division of capital planning and operations", in the first sentence, the words:- headed by a commissioner.

SECTION 3. Said section 4A of said chapter 7, as appearing in the 1988 Official Edition, is hereby further amended by striking out, in lines 51 and 57, the word:- deputy.

SECTION 4. Section 38A> of said chapter 7, as so appearing, is hereby amended by striking out, in line 65, the word "deputy" each time it appears.

SECTION 5. Section 38F of said chapter 7, as so appearing, is hereby amended by striking out, in lines 20 and 23, in each instance, the word "deputy".

SECTION 6. Section 38G of said chapter 7, as so appearing, is hereby amended by striking out, in lines 2, 3, 5, 9, 11, 13, 15, 20, 21, 25 and 27, the word "deputy".

SECTION 7. Section 38H of said chapter 7, as so appearing, is hereby amended by striking out, in lines 6, 11, 19 and 25, in each instance, the word "deputy".

SECTION 8. Section 38I of said chapter 7, as so appearing, is hereby amended by striking out, in line 1, the word "deputy".

SECTION 9. Section 38J of said chapter 7, as so appearing, is hereby amended by striking out, in lines 7 and 9, in each instance, the word "deputy".

SECTION 10. Section 39A of said chapter 7, as so appearing, is hereby amended by striking out, in lines 31 and 135, in each instance, the word "deputy".

SECTION 11. Section 39B of said chapter 7, as so appearing, is hereby amended by striking out, in lines 2, 15, 59, 63, 67 and 72, in each instance, the word "deputy", and by adding after line 13 the following:- "The commissioner may, subject to appropriation, appoint deputy commissioners and associate deputy commissioners and legal counsel as appropriate and may authorize such deputy commissioners or associate deputy commissioners or legal counsel to act in his/her stead in particular matters or classes of matters,".

SECTION 12. Section 39C of said chapter 7, as so appearing, is hereby amended by striking out, in lines 1, 11, 12 and 21, in each instance, the word "deputy".

SECTION 13. Section 40A of said chapter 7, as so appearing, is hereby amended by striking out, in line 42, the word "deputy".

SECTION 14. Section 40B of said chapter 7, as so appearing, is hereby amended by striking out, in lines 1, 14, 16 and 18, in each instance, the word "deputy".

SECTION 15. Section 40C of said chapter 7, as so appearing, is hereby amended by striking out, in lines 1, 33, 41, 47, 53, 56 and 63, in each instance, the word "deputy".

SECTION 16. Section 40D of said chapter 7, as so appearing, is hereby amended by striking out, in lines 1, 6, 18, 22, 26, 39, 40, 48, 59, 69, 74, 79, 93, 95, 108 and 110, in each instance, the word "deputy".

SECTION 17. Section 40E of said chapter 7, as so appearing, is hereby amended by striking out, in lines 15, 46, 48, 53, 56 and 59, in each instance, the word "deputy".

SECTION 18. SECTION 19. Section 40F> of said chapter 7, as so appearing, is hereby amended by striking out, in lines 2, 5, 7, 15, 18, 22, 29, 32, 36, 40, 47, 49, 52, 57, 61, 64, 66, 74, 78, 80, 88, 96, 102 and 104, in each instance, the word "deputy".

SECTION 20. Section 40G of said chapter 7, as so appearing, is hereby amended by striking out, in lines 1, 8, 10, 21, 32, 38, 40 and 45, in each instance, the word "deputy".

SECTION 21. Section 40H of said chapter 7, as so appearing, is hereby amended by striking out, in lines 6, 20, 23, 26, 29, 41, 47, 49, 54, 56 and 62, in each instance, the word "deputy".

SECTION 22. Section 40I of said chapter 7, as so appearing, is hereby amended by striking out, in lines 4, 13, 14, 15 and 19, in each instance, the word "deputy".

SECTION 37. Section 42G of said chapter 7, as so appearing, is hereby amended by striking out, in line 30, the word "deputy".

SECTION 57. Section 44J of said chapter 149, as most recently amended by section 79 of the Acts of 1989, is hereby further amended by striking out, in the second sentence of subsection one, in the first sentence of subsection six and in the second sentence of subsection six, the word "deputy".

SECTION 58. Section 17 of chapter 211B of the General Laws, as appearing in the 1988 Official Edition, is hereby amended by striking out, in line 25, the word "deputy".
