CHAPTER 493 AN ACT FURTHER AUTHORIZING THE DIVISION OF CAPITAL PLANNING AND OPERATIONS TO CONVEY CERTAIN PARK LAND IN THE TOWN OF HULL TO THE HULL REDEVELOPMENT AUTHORITY.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 1 of chapter 644 of the acts of 1987 is hereby amended by adding the following paragraph:-

The more precise configuration of these parcels shall be as shown on that plan of land referenced within this act, as it is further revised and recorded with the Plymouth county registry of deeds, and in the event of any inconsistency between the legal description of said parcels as contained in this act and the recorded plan, said plan shall control.

SECTION 2. Said chapter 644 is hereby further amended by adding the following paragraph:-

The more precise configuration of these parcels shall be as shown on that plan of land referenced within this act, as it is further revised and recorded with the Plymouth county registry of deeds, and in the event of any inconsistency between the legal description of said parcels as contained in this act and the recorded plan, said plan control.

SECTION 3. Said chapter 644 is hereby further amended by inserting after section 3 the following section:-

Section 3A. No deed or instrument conveying real property interests or otherwise affecting title conveying real property interests or otherwise affecting title to the parcels of land located in the town of Hull and described within this chapter shall be valid unless it references that plan of land entitled "MDC/HRA Land Exchange Plan in Hull (Plymouth County) Mass.", dated May 7, 1987, revised through August 16, 1988, and recorded August 19, 1988 with the Plymouth county registry of deeds in Plan Book 31, Page 211. In the event that all or a portion of the description of any of the parcels set forth within this chapter contradicts or is otherwise inconsistent with the description of such parcels as shown upon said plan of record, then said plan of record and any subsequent plans of record shall control as to the accuracy and correctness of such description.

SECTION 4. Section 4 of said chapter 644 is hereby amended by striking out, in lines 2 and 3, the words "within three years of the effectiveness date of this act".

SECTION 5. Said section 4 of said chapter 644 is hereby further amended by inserting after the first sentence the following sentence:- In the event that the property described in section one reverts to the commonwealth, the deputy commissioner, notwithstanding any general or special law to the contrary, shall transfer the property described in section two to the Hull Redevelopment Authority, or its successors, so long as the costs, fees and expenses of such transfer and the restoration of the properties are paid by the recipient.

SECTION 6. This act shall take effect upon its passage.
