CHAPTER 504 AN ACT AUTHORIZING THE DIVISION OF CAPITAL PLANNING AND OPERATIONS TO CONVEY CERTAIN LAND IN THE TOWN OF FOXBOROUGH TO THE FOXBOROUGH HOUSING AUTHORITY.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey by deed, approved as to form by the attorney general, a certain parcel of land and the buildings thereon, located in the town of Foxborough, to the Foxborough housing authority, subject to the requirements of sections two, three, and four and to such additional terms and conditions as the deputy commissioner may prescribe, in consultation with the department of mental health.

Said parcel is bounded and described as follows:

Beginning at a granite marker post situated at the intersection of the northerly line of Chestnut Street and the westerly line of a railroad right-of-way, now or formerly of the New York, New Haven and Hartford Railroad;

thence S89 16'31"W, two hundred ninety-one and 47/100 (291.47) feet along said northerly line of Chestnut Street to a beginning of a curve;

thence northwesterly, more or less, an arc length of fifty-five and 11/100 (55.11) feet, along a curve to the right with a radius of thirty (30.00) feet to a point on the easterly line of the east access road to Foxborough State Hospital;

thence N14 31'12"E, one hundred eleven and 71/100 (111.71) feet, northeasterly by land now or formerly of the commonwealth of Massachusetts;

thence N20 31'12"E, one hundred forty (140.00) feet, northeasterly by land of said commonwealth;

thence N85 31'11"E, one hundred fifty (150.00) feet, easterly to a point on the westerly line of a railroad right-of-way, now or formerly of the New York, New Haven and Hartford Railroad;

thence S18 18'36"E, three hundred (300.00) feet, along said westerly line of a railroad right-of-way to the point of beginning.

Said parcel contains approximately 1.57 acres as shown on a plan of land prepared by Bay Colony Surveying, Inc., Foxborough, on file with the division of capital planning and operations.

SECTION 2. No deed conveying by or on behalf of the commonwealth property described in section one shall be valid unless such deed provides that said property shall be used for the construction, establishment, maintenance, and operation of state-assisted housing, as defined in chapter one hundred and twenty-one B of the General Laws.

SECTION 3. The Foxborough housing authority shall assume the costs of appraisals, surveys, and other expenses as deemed necessary by the deputy commissioner for the conveyance of this property described in section one.

SECTION 4. In the event that the above mentioned parcel described in section one is not used for the purposes described in section two within five years of the effective date of this act, or if the Foxborough housing authority ceases to use the parcel for such purpose at any time, the parcel shall revert to the commonwealth under such terms and conditions as the deputy commissioner may prescribe.
