Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The city of Newburyport, acting through its board of sewer commissioners with the approval of the mayor, is hereby authorized to enter into an agreement with the Guschov Newbury Elderly Housing Project located in the town of Newbury, for the disposal of sewage emanating from said project.
Said contract may allow for the use of the system of sewer mains, or any portion thereof, belonging to the city of Newburyport. The board of sewer commissioners with the approval of the mayor may extend, renew, amend or alter said contract or any part thereof.
Said housing project shall pay all costs, charges, and fees arising from, or incidental to its utilizing the mains, pumping stations, and related facilities owned by or available to the city of Newburyport, including:
(a) Engineering, planning and drawing fees for the design or redesign of any mains or systems necessary to carry the flow from said project.
(b) Obtaining, utilizing and protecting easements or other rights necessary for laying mains to transport sewage from said project to the mains of the city of Newburyport.
(c) The laying, maintaining, and servicing of the mains laid from said project to the mains of the city of Newburyport.
(d) All legal, engineering or other costs and fees connected with, or incidental to, the preparation for, connection with, or operation of the connection of mains belonging to said project to the mains of the city of Newburyport.
(e) The periodic cost of operation, as determined by the city of Newburyport.
SECTION 2. The city of Newburyport is hereby authorized to exercise all of the powers conferred by sections four to twenty-four, inclusive, of chapter eighty-three of the General Laws with respect to the provision of sewer entry permits and related services to said housing project.
SECTION 3. This act shall take effect upon its passage.
