Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
The commissioner of the division of capital planning and operations is hereby authorized, notwithstanding the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to convey in fee simple by deed approved as to form by the attorney general, a certain parcel of land located in the town of Hadley, to John F. Koloski and Phyllis P. Koloski subject to such terms and conditions as said commissioner may prescribe in consultation with the department of environmental management. Said land being bounded and described as follows:-
Beginning at a point on the Easterly sideline of West Street and the Southerly sideline of land of The Commonwealth of Massachusetts (formerly Boston and Maine Railroad) said point being the Northwest corner of land of John F. and Phyllis P. Koloski as deeded in Book 1393, Page 495 thence;
N 03<= 09' 30" W along the said Easterly sideline of said West Street a distance of 16.99' to an iron pin to be set at other land of the said Commonwealth of Massachusetts thence;
N 76<= 02' 52" E along other land of the said Commonwealth of Massachusetts a distance of 91.05' to a point at other land of the said Commonwealth of Massachusetts thence;
N 85<= 36' 22" E along other land of the said Commonwealth of Massachusetts a distance of 57.75' to an iron pin to be set in the said Southerly sideline of land of the said Commonwealth of Massachusetts and the Northerly sideline of said land of said Koloski thence;
S 73<= 21' 34" W along the said Northerly sideline of said Koloski a distance of 151.35' to the point and place of beginning.
Containing 1,687 square feet of land, more or less.
Together with a fifteen foot wide right of way to pass and repass, by foot or vehicle, and to use said right of way for all purposes permitted by the Hadley zoning by-law and other local, state, and federal law. This right of way shall be appurtenant to and run with the property of John F. Koloski and Phyllis P. Koloski as conveyed in the deed of Frank Koloski recorded in Hampshire county registry of deeds at Book 1393, Page 495 and the property to be conveyed by the division of capital planning and operations pursuant to the authorization contained herein, to be shown on the plan described below.
