Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding the provisions of chapter forty-eight of the Special Acts of nineteen hundred and fifteen, there is hereby established in the town of Marion a board of health. Said board shall consist of three members, who shall be elected at the annual meeting of the town following the effective date of this act, one of whom shall serve a term of one year, one of whom shall serve a term of two years and one of whom shall serve a term of three years, each successive election thereafter to be for the term of three years. The members of said board shall, at their first meeting following the annual meeting of the town, and thereafter at least annually, select one of said members to be chairman with the duties and authority vested by law in the chairman.
SECTION 2. Notwithstanding the provisions of chapter forty-eight of the Special Acts of nineteen hundred and fifteen and chapter thirty-five of the acts of nineteen hundred and thirty-two, upon the election of the members of the board of health created by section one, the board of selectmen shall be divested of those powers, duties and obligations vested by law in boards of health, all of which powers, duties and obligations shall be vested in and imposed on said board of health, except that said board of selectmen shall retain those powers, duties and obligations of a board of health under sections seventeen, thirty-one A and thirty-one B of chapter one hundred and eleven of the General Laws. The board of selectmen of said town shall be solely responsible for the maintenance, operation and regulation of the municipal water supply, drainage and sewerage systems.
SECTION 3. This act shall take effect upon its passage.
