Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The city of Lowell, acting by and through its city council, is hereby authorized to convey a certain parcel of land located in said city acquired for conservation purposes to the commonwealth, by and through its department of environmental management, to be used for conservation and recreation purposes.
Said parcel of land being described as follows:
City-Owned land on the southerly side of Pawtucket Boulevard. Said parcel is shown as Lot A on a Plan entitled, "Compiled Subdivision Plan of Land in Lowell, Mass. belonging to city of Lowell, April 25, 1989, city engineers office, City Hall, Lowell, Mass."
Excepted and excluded from this conveyance by the city of Lowell are all easements for wires, pipes, conduits, poles and other appurtenances for the conveyance of water, sewage, gas, oil, electricity and telephone communication now lawfully in or on the premises hereby conveyed, and further excepting and excluding from this conveyance the following rights, easements and takings:
(1) 30' wide drainage easement owned by the City of Lowell and shown on the plan referenced above;
(2) New England Power Co. easement as shown on the plan referenced above and as may be described in the following easements, all recorded with Middlesex North District Registry of Deeds:
(a) Easement to Massachusetts Electric Co., Book 1359, Page 508;
(b) Easement to Massachusetts Electric Co., Book 2401, Page 640;
(c) Easement to Massachusetts Electric Co., Book 2401, Page 665;
(d) Easement to Massachusetts Electric Co., Book 2401, Page 660;
(e) Easement to New England Telephone and Telegraph, Book 2401, Page 670.
(3) Taking by the Massachusetts Department of Public Works for Pawtucket Boulevard (Route 113) recorded with said Deeds, Book 1347, Page 91;
(4) Taking by the Massachusetts Department of Public Works for Pawtucket Boulevard (Route 113) recorded with said Deeds, Book 1537, Page 477.
(5) Taking by the Massachusetts Department of Public Works for Pawtucket Boulevard (Route 113) recorded with said Deeds, Book 4819, Page 6.
(6) Grants and flowage rights of the Proprietors of the Locks and Canals, recorded with Middlesex North District Registry of Deeds as follows:

SECTION 2. This act shall take effect upon its passage.
