Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, the town of Wellesley is hereby authorized to establish by by-law a municipal light board, consisting of five members, three of whom shall be the members of the board of public works of said town and two of whom shall be appointed by the board of selectmen of said town, which shall have the powers and duties of municipal light commissioners under the General Law. Said municipal light board shall appoint a manager of the municipal light plant and such staff as it deems necessary. Said board shall have overall authority and responsibility with respect to the management and operation of said town's municipal light plant.
SECTION 2. Of the two members of said board initially appointed by the board of selectmen of the town of Wellesley one member shall be appointed for a term of three years and one member to be appointed for a term of two years. Their successors shall be appointed for a term of three years. Members may serve for more than one term, as shall be determined by the appointing authority. The terms of the three members of said board who are members of the board of public works of said town shall be coterminous with their terms as members of the board of public works.
SECTION 3. Upon the appointment and qualification of the members of the municipal light board in addition to the members of the board of public works of the town of Wellesley, all duties, responsibilities and obligations of the board of public works of the town relative to the management of the municipal light plant shall be transferred to said board as provided by by-laws.
The rights of an employee of the board of public works of said town shall not be impaired by the implementation of this act.
SECTION 4. This act shall take effect upon its passage.
