CHAPTER 132 AN ACT PROVIDING FOR THE EXECUTIVE OFFICE OF HEALTH AND HUMAN SERVICES FACILITY CONSOLIDATIONS.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to immediately provide funds for the consolidation of health and human services facilities, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. To provide for a program of facility consolidation, including the study, design, construction, reconstruction, renovation, and improvement to various state institutions and properties, and related project administration costs, and for the purchase of certain property, including furnishings, equipment, and renovations to such property consistent with the recommendations of the governor's special commission on the consolidation of health and human services institutional facilities, hereinafter called the special commission, the sums set forth in section two of this act, for the several purposes and subject to the conditions in this act, are hereby made available, subject to the provisions of law regulating the disbursement of public funds and the approval thereof. Any capital expenditure authorized by this act shall be exempt from the provisions of sections twenty-five C to twenty-five G, inclusive, of chapter one hundred and eleven of the General Laws or any other general or special law requiring determination of need. The secretary of health and human services shall submit to the house and senate committees on ways and means a report, on or before February first of each year, a multi-year spending plan summarizing the expenditures on each item of authorization and the status of all such projects authorized by section two of this act.

provided, that said systems and projects may include, without limitation, the client registration and enrollment system and the communications infrastructure for the department of mental health; for unexpected emergencies; provided, that no money shall be expended from this item unless and until the town of Belchertown accepts full legal operation and ownership of said waste water treatment plant; provided further, that notwithstanding the provisions of chapter seven of the General Laws, the division of capital planning and operations is hereby authorized and directed to convey by deed approved as to form by the attorney general to said town, a certain parcel of land which shall contain said waste water treatment plant and adjacent land essential to its operation and easements necessary for access to said parcel; SECTION 3. To meet the expenditures necessary in carrying out the provisions of section two of this act, the state treasurer shall, upon the request of the governor, issue and sell bonds of the commonwealth, in an amount specified by the governor from time to time, not exceeding one hundred sixty-six million two hundred ninety thousand seven hundred fifty-five dollars. All bonds issued by the commonwealth, as aforesaid, shall be designated on their face, Human Services Consolidation Capital Outlay Loan, Act of 1993, and shall be issued for a maximum term of twenty years, as the governor may recommend to the general court pursuant to Section 3 of Article LXII of the Amendments to the Constitution of the Commonwealth; provided, however, that all such bonds shall be payable no later than June thirtieth, two thousand and nineteen. All interest and payments on account of principal of such obligations shall be payable from the General Fund, unless otherwise specified. Bonds and interest thereon issued under the authority of this section shall be general obligations of the commonwealth.

SECTION 4. The state treasurer may borrow from time to time on the credit of the commonwealth such sums of money as may be necessary for the purpose of meeting payments authorized by section two of this act and may issue and renew from time to time notes of the commonwealth therefor, bearing interest payable at such time and at such rates as shall be fixed by the state treasurer. Such notes shall be issued and may be renewed one or more times for such term, not exceeding one year, as the governor may recommend to the general court in accordance with Section 3 of Article LXII of the Amendments to the Constitution of the Commonwealth, but the final maturities of the notes, whether original or renewal, shall not be later than June thirtieth, nineteen hundred and ninety-nine. Notes and interest thereon issued under the authority of this section shall be general obligations of the commonwealth. All interest and payments on account of principal of such obligations shall be payable from the General Fund, unless otherwise specified.

SECTION 5. Item 5655-8841 in section 2 of chapter 723 of the acts of 1983 is hereby amended by striking out, in line 7, the figure "1,545,000" and inserting in place thereof the following figure:- 1,539,094.

SECTION 6. Section 11 of said chapter 723 is hereby amended by striking out, in line 4, the words "nine thousand thirty-five" and inserting in place thereof the following words:- three thousand one hundred and twenty-nine.

SECTION 7. Item 5011-8874 in section 2 of chapter 167 of the acts of 1987 is hereby amended by striking out, in line 24, the figure "3,200,000" and inserting in place thereof the following figure:- 3,150,534.
