Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding any law to the contrary, the town of Nantucket, acting by and through its board of selectmen, in consultation with the Nantucket conservation commission, is hereby authorized to construct a channel from each of the great ponds, and to close such channels, listed below on Nantucket Island to the ocean across barrier beaches without the need of approval, permits or authorizations of any kind from the commonwealth or any of its subdivisions, departments or agencies, and may raise and appropriate such sums of money as may be necessary to accomplish such purpose.
The four great ponds on Nantucket Island subject to this act are Sesachacha Pond, Long Pond, Hummock Pond and Miacomet Pond.
Said town may take by eminent domain under chapter seventy-nine of the General Laws, or acquire by lease, purchase or otherwise, such land and easements within its limits as may be necessary for the construction and maintenance of such channels.
SECTION 2. This act shall take effect upon its passage.
