Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The town of Hudson, acting through its board of selectmen, is hereby authorized to provide the construction, operation, extension and maintenance of a sewerage line in the town of Bolton for the benefit of the land described in section two and to provide sewerage services to certain residences and buildings in said town of Bolton as so described in said section two. All construction and installation of a sewerage line in said town of Bolton shall be performed in accordance with applicable regulations of said town of Bolton and as may be approved by the board of selectmen of the town of Hudson. All construction and installation of sewerage lines in said town of Hudson shall be in accordance with applicable regulations of said town of Hudson. Construction, operation and maintenance of a sewerage line shall be the responsibility of the owners of the properties located in said town of Bolton to be serviced by said sewerage line. Notwithstanding the provisions of any general or special law or rule or regulation to the contrary, the town of Bolton shall not be responsible for any construction, operation, maintenance or repair of said sewerage line or any extensions or additions thereof. A deed of conveyance by a grantor, his heirs, successors, nominees or assigns, of any parcel of real property connected to, or to be connected to, any extension or addition of said sewerage line shall contain an identifying reference to this act by citing the number, date of enactment and title hereof.
SECTION 2. The town of Hudson, acting through its board of selectmen, shall bill the owners of residences and buildings constructed on certain parcels of land in the town of Bolton, and tied into said system shown as lots 1, 2, 3, 4, 5, 6 and 7 on a plan entitled: Plan of Land in Bolton, Stow and Hudson, Massachusetts, prepared by David E. Ross Associations, Inc., revised through October, 1992, and on file at the town clerk's office in said town of Bolton hereinafter referred to as said "plan". Said town of Hudson may provide sewerage services to other residential and commercial buildings or new construction in said town of Bolton only if the board of selectmen of said town of Bolton, by majority vote, so authorizes the provisions of said services and, if so authorized, by a majority vote of the selectmen of said town of Hudson; provided, however, that new construction shall not include replacement of a building or residence that has been destroyed by fire or other natural causes, which building was previously serviced by said system.
SECTION 3. In addition to its authority set forth in section one, the board of selectmen of the town of Bolton may authorize the town of Hudson, acting through its board of selectmen and jointly with the owners of the property identified on the plan described in section two, their agents, representatives and employees, to excavate and open Woobley road in said town of Bolton for the purpose of constructing, extending and maintaining the sewerage lines authorized by section one, with notice to abutters of said property, but without the necessity of a public hearing being held, notwithstanding any other provision of general or special law to the contrary. The owners of property identified on said plan shall comply with the rules and regulations of said town of Bolton relative to the excavation and opening of streets, the construction and installation of sewerage lines and the terms and conditions of a permit that may be issued by the board of selectmen of said town of Bolton relative thereto. The owners of property identified on said plan shall reimburse said town of Bolton and the inhabitants thereof for any damage incurred by said town or its inhabitants or to land, improvements or premises in said town if such damage results from an act of the owners in connection with constructing the system authorized in section one. The owners of the property identified on said plan shall reasonably restore all land, improvements or buildings in said towns of Bolton and Hudson which may be altered in the process of construction, operation, extension or maintenance of the sewerage line authorized in section one to its condition prior to such alteration.
SECTION 4. The town of Hudson shall bill property owners within the town of Bolton to which it supplies sewerage services under the provisions of section two in accordance with the rates established by the board of selectmen of said town of Hudson. Such rates shall not exceed rates paid by residents of said town of Hudson for similar services. Said town of Hudson shall have such rights against any resident of the town of Bolton to whom it is supplying sewerage services and whose bill for such service is not paid on or before its due date, as provided in sections sixteen A to sixteen D, inclusive, of chapter eighty-three of the General Laws.
SECTION 5. This act shall take effect upon its passage.
