Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The commissioner of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to convey by deed approved as to form by the attorney general, permanent access and utility easements located in the town of Holbrook to an individual or entity, subject to the requirements of sections two to four, inclusive, and to such terms and conditions as the commissioner may prescribe in consultation with the department of environmental management, said easements being described as follows:
Said emergency access and utility easements being over land owned by the commonwealth, under the care and control of the division of forest and parks, as shown as proposed roadway easement area of 3043 + S.F. upon Lot A shown on a plan entitled "Easement Plan, Plan of Land, Holbrook, Mass., Lot A Pine Street", dated November 13, 1987; scale 1" 40'; drawn by John Levreault, Levreault Engineering, Holbrook, Mass. 02343 and on file with the division of capital planning and operations and to be recorded with said conveyance of easement interests.
SECTION 2. No deed conveying by or on behalf of the commonwealth easements described in section one shall be valid unless such deed provides that said easements shall be used for the purpose of emergency access to George street in the town of Holbrook and the installation, construction and maintenance of utilities by the town of Holbrook.
SECTION 3. If the use described in section two is not begun within two years after the effective date of this act, or ceases at any time thereafter, said easements shall revert to the commonwealth under such terms and conditions as the commissioner of capital planning and operations may prescribe.
SECTION 4. The recipient of the easements described in section one shall assume the costs of any appraisals, surveys, and other expenses as deemed necessary by the commissioner of capital planning and operations for the granting of such easements.
