Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Chapter 766 of the acts of 1981 is hereby amended by inserting after section 2 the following section:-
Section 2A. The rent control board is hereby authorized to act as an arbitrator for disputes between tenants and park owners relative to maintenance of mobile home parks and mobile home park regulations.
SECTION 2. Said chapter 766 is hereby further amended by inserting after section 8 the following section:-
Section 8A. Notwithstanding section thirty-two R of chapter one hundred and forty of the General Laws or any other general or special law to the contrary, any incorporated home owners' association in the town of Williamstown, entitled to notice under said section thirty-two R, shall have the right to purchase, in the case of a third party bona fide offer to purchase, or to lease in the case of a third party bona fide offer to lease, the said park, provided it meets the price and substantially equivalent terms and conditions of any offer of which it is entitled to notice under said section thirty-two R, by executing a contract or purchase and sale or lease agreement with the owner within ninety days of notice of the offer, and by obtaining any necessary financing or guarantees within an additional forty-five days. The Williamstown rent control board shall have the right to verify the existence of a bona fide offer to purchase or lease said park if requested by the tenants association. No owner shall unreasonably delay the execution of a purchase and sale or lease agreement with a home owners' association that has made a bona fide offer to meet the price and substantially equivalent terms and conditions of an offer for which notice is required to be given pursuant to said section thirty-two R. Failure of the incorporated home owners' association to execute such a purchase and sale or lease agreement within the first ninety day period or to obtain a binding commitment for financing within an additional forty-five day period shall serve to terminate the right of such association to purchase or lease the mobile home park. The time period herein may be extended by agreement of the association and the owner.
