CHAPTER 310 AN ACT PROVIDING FOR THE PROTECTION OR RESTORATION OF THE RIGHTS OF CERTAIN PUBLIC EMPLOYEES.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to immediately protect or restore the rights of certain public employees, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

Chapter 534 of the acts of 1976 is hereby amended by striking out section 1 and inserting in place thereof the following section:-

Section 1. If the rights of any person acquired under the provisions of chapter thirty-one of the General Laws or under any rule made thereunder have been prejudiced through no fault of his own, the civil service commission may take such action as will restore or protect such rights, notwithstanding the failure of any person to comply with any requirement of said chapter thirty-one or any such rule as a condition precedent to the restoration or protection of such rights.

This Bill having been returned by His Excellency the Governor with his objections thereto in writing (see House 5638) has been passed by the House of Representatives, notwithstanding said objections, two-thirds of the House (140 yeas to 0 nays) having agreed to pass the same.
