Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey by deed, a certain parcel of land known as Pagel Playground located in the city of Boston to the city of Boston for recreational purposes and subject to the requirements of sections two, three and four of this act and to such additional terms and conditions as the commissioner may prescribe.
Said parcel of land contains sixty-six thousand one hundred and forty square feet more or less, and is bounded and described as follows:
Beginning at the intersection of the boundary line between land now or formerly of Bowers Motor Sales, Inc. and land of the city of Boston with the northwesterly side line of Hyde Park Avenue, as shown on said plan:
Thence the line runs south 6<= 17' 49" west by said northwesterly side line of Hyde Park Avenue, two hundred fifty and 00/000 (250.00) feet to a point at land now or formerly of Bowers Motor Sales, Inc.;
Thence north 83<= 42' 11" west by said land of Bowers Motor Sales, Inc. one hundred ninety-six and 65/100 (196.65) feet to a point of land now or formerly of the New York, New Haven & Hartford Railroad;
Thence south 47<= 50' 05" east by said land of the city of Boston two hundred sixty-one and 63/100 (261.63) feet to a point of beginning; being shown on the aforesaid plan and comprising sixty-six thousand one hundred forty (66,140) square feet more or less of land owned by the commonwealth.
SECTION 2. A deed conveying by or on behalf of the commonwealth the property described in section one shall not be valid unless such deed provides that said property shall be used for recreational purposes.
SECTION 3. The city of Boston shall pay the costs of appraisals, surveys or other expenses deemed necessary by said commissioner for the conveyance of this property.
SECTION 4. Title to the aforesaid parcel of land shall revert to the commonwealth, without consideration, if the land is not used for the purposes stated in section two, or if any condition or restriction imposed under the authority of this act is not complied with within five years from the effective date of this act.
