Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, the board of selectmen of the town of Winthrop, acting for and on behalf of said town, is hereby authorized and directed to grant, for nominal consideration, seven permanent easements in certain parcels of land in said town, acquired by said town for park and recreational purposes, to the Massachusetts Water Resources Authority for the purposes of installing, maintaining and operating sections of a regional water supply pipeline, which when completed will provide water service to the wastewater treatment facility being constructed on Deer Island in the city of Boston to service the needs of the Boston metropolitan area sewerage system.
The first such permanent easement is shown as Parcel No. 10 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing Nos. W-7 and W-8, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., being bounded and described as follows:
Beginning at a point on the southerly side of Petrel Street, a private way, approximately 87.78 feet from the intersection of said Petrel Street and Shirley Street, a public way;
Thence continuing S 09<= 36' 04" W a distance of 37.59 feet by land now or formerly of Zita Q. Quigley;
Thence turning S 12<= 07' 56" W a distance of 40.02 feet by land now or formerly of Eleanor L. Bannon;
Thence turning S 10<= 42' 05" W a distance of 40.00 feet by land now or formerly of Carol A. MacIsaac;
Thence turning S 10<= 16' 20" W a distance of 23.71 feet by land now or formerly of John J. Kearney and Alice G. Kearney;
Thence turning S 82<= 28' 34" E a distance of 20.05 feet to a point;

Containing an area of 20,232 square feet, more or less, according to said plan.
Said permanent easement being over land of the town of Winthrop, described in certificate of title no. 2433 dated June fourteenth, nineteen hundred and nine and filed with the Suffolk registry district of the land court and an order of taking of the town of Winthrop dated July tenth, eighteen hundred and eighty-nine recorded with the Suffolk county registry of deeds in Book 1886, Page 385.
The second such permanent easement is shown as Parcel No. 8 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-6, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., being bounded and described as follows:
Beginning at a point on land of the Town of Winthrop by land now or formerly of John J. Kearney and Alice G. Kearney having the coordinates N 497144.26 / E 743133.29 as shown on said plan, and continuing S 10<= 16' 20" W a distance of 16.29 feet;
Thence turning and running S 03<= 29' 27" W a distance of 394.60 feet to a point at the intersection of Brewster Avenue and Nerious Street, both private ways;
Thence turning and running S 77<= 50' 51" E a distance of 20.05 feet to a point on the center line of the seawall presently located on land of the Town of Winthrop as shown on said plan;

The third such permanent easement is shown as Parcel No. 9B on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-6, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., being bounded and described as follows:
Beginning at a point on the easterly side of Brewster Avenue, a private way, as shown on said plan and running N 03<= 42' 24" E a distance of 276.08 feet to a point;
Thence turning and running S 00<= 40' 34" E a distance of 399.44 feet along the center line of the seawall located on land of the Town of Winthrop as shown on said plan;
Thence turning and running S 86<= 03' 26" W a distance of 7.61 feet to a point;
Thence turning and running N 06<= 18' 20" W a distance of 126.62 feet to the point of beginning.
Containing 4,440 square feet, more or less, according to said plan.
Said permanent easement being over land of the town of Winthrop, described in certificate of title no. 45664 dated June twenty-seventh, nineteen hundred and forty-five and filed with the Suffolk Registry district of the land court.
The fourth such permanent easement is shown as Parcel No. 12A on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-8, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., being bounded and described as follows:
Beginning at a point on the easterly side of Shirley Street, a public way, approximately 218.82 feet from the intersection of said Shirley Street and Terrace Avenue and continuing S 25<= 47' 48" E a distance of 21.82 feet to a point on said Shirley Street;
Thence turning and running S 19<= 43' 09" W a distance of 53.84 feet to a point;
Thence turning and running S 26<= 45' 21" E a distance of 13.99 feet to a point;
Thence turning and running S 20<= 57' 01" W a distance of 18.91 feet to a point;
Thence turning and running S 71<= 06' 25" E a distance of 20.01 feet to a point;

The fifth such permanent easement is shown as Parcel No. 6 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-5, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., being bounded and described as follows:
Beginning at a point on the easterly side of Brewster Avenue, a private way, having the coordinates N 496143.08 / E 743121.99 and continuing S 07<= 12' 34" E a distance of 299.88 feet to a point;
Thence turning and running S 15<= 01' 40" E a distance of 73.95 feet to a point;
Thence turning and running southwesterly by land now or formerly of Jeremiah Green, a distance of 8.25 feet to a point;

The sixth such permanent easement is shown as Parcel No. 22 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-18, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resource Engineers, Inc., being bounded and described as follows:
Beginning at a point on the northerly side of Kennedy Road, a public way, at coordinates N 505252.84 / E 740122.29 as shown on said plan and continuing N 27<= 36' 23" E a distance of 498.74 feet to a point;
Thence turning and running N 46<= 40' 16" W a distance of 273.27 feet to a point;
Thence turning and running N 59<= 10' 15" W a distance of 51.21 feet to a point;
Thence turning and running N 43<= 19' 28" E a distance of 36.07 feet to a point;

The seventh such permanent easement is shown as Parcel No. 22A on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-19, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resource Engineers, Inc., being bounded and described as follows:
Beginning at a point at land of the Town of Winthrop having the coordinates N 505911.80 / E 740114.32, as shown on said plan and running N 59<= 10' 15" W a distance of 36.34 feet to a point;
Thence turning and running N 24<= 58' 27" W a distance of 206.20 feet to a point;
Thence turning and running S 45<= 21' 09" E a distance of 58.67 feet to a point;
Thence turning and running S 24<= 58' 27" E a distance of 96.45 feet to a point;

SECTION 2. Notwithstanding the provisions of any general or special law to the contrary, the board of selectmen of said town of Winthrop, acting for and on behalf of said town, is hereby authorized and directed to grant, for nominal consideration, four temporary easements in certain parcels of land in said town, acquired by said town for park and recreational purposes, to the Massachusetts Water Resources Authority for the purposes of using and occupying said temporary easements for the passage of workers and vehicles, the transportation of machinery and materials and for depositing machinery, dirt, tools and other materials so deposited thereon in connection with installing, maintaining and operating sections of a regional water supply pipeline, which when completed will provide water service to the wastewater treatment facility being constructed on Deer Island in the city of Boston to service the needs of the Boston metropolitan area sewerage system; provided, however, that such temporary easements shall expire not later than four years from the date of recording of an instrument granting such easements.
The first such temporary easement is shown as Parcel No. T-6 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing No. W-5, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., to be filed with the Suffolk registry district of the land court and to be recorded with Suffolk deeds herewith, being bounded and described as follows:
Beginning at a point on the center line of the seawall located on said Parcel No. T-6 as shown on said plan and having the coordinates N 496143.08 / E 743121.99 and running S 07<= 12' 34" E a distance of 299.88 feet to a point;
Thence turning and running S 15<= 01' 40" E a distance of 73.95 feet to a point;
Thence turning and running southwesterly by land now or formerly of Jeremiah Green, a distance of 23.58 feet to a point;
Thence turning and running N 15<= 01' 40" W a distance of 59.10 feet to a point;

The second temporary easement is located in Winthrop, Suffolk County, Massachusetts, being shown as Parcel No. T-7 on a plan entitled "Massachusetts Water Resources Authority, Deer Island Overland Utilities, Winthrop, Mass.," Drawing Nos. W-6, Scale 1" = 40', dated September eighth, nineteen hundred and eighty-nine, prepared by Hydraulic & Water Resources Engineers, Inc., Waltham, Mass., to be filed with the Suffolk registry district of the land court and to be recorded with Suffolk county registry of deeds herewith, being further bounded and described as follows:
Beginning at a point on the center line of the sea wall located on said Parcel No. T-7 as shown on said plan and having the coordinates N 497141.64 / E 743153.17 and running S 03<= 25' 40" W a distance of 600.21 feet to a point;
Thence turning and running S 00<= 40' 34" E a distance of 399.44 feet to a point;

Beginning at a point 40.02 feet from the easterly side of Shirley Street having the coordinates N 498098.73 / E 743435.29 as shown on said plan and running N 71<= 06' 25" W a distance of 20.01 feet to a point;
Thence turning and running N 20<= 57' 01" E a distance of 97.09 feet to a point;
Thence turning and running S 69<= 51' 43" E a distance of 20.00 feet to a point;
Thence turning and running S 20<= 57' 01" W a distance of 96.62 feet to the point of beginning.
Containing 1,937 square feet, according to said plan.
Said temporary easement being over land of the town of Winthrop, described in an order of taking dated July tenth, eighteen hundred and eighty-nine recorded with Suffolk county registry of deeds, Book 1886, Page 385.
SECTION 3. The configuration of each of the easements described in this act shall be as shown on the applicable plan of land referred to in sections one and two as such plan is later revised, if necessary, and recorded with the Suffolk county registry of deeds. In the event that the description of any of the easements referred to in this act is inconsistent with such easements as shown upon the plan so recorded, then said plan of record and any subsequent plan of record shall control as to the accuracy and correctness of such description; provided, however, that the easement described in said revised plans are within the limits of the bounds described in said sections one and two.
SECTION 4. This act shall take effect upon its passage.
