Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
as follows:
SECTION 1. The commissioner of the division of capital planning and operations is hereby authorized subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to grant an easement for access to, utilities, and the construction, maintenance, operation, replacement, addition to and removal of a water irrigation system within a certain parcel of land and the SuAsCo watershed project located in the town of Westborough, to the town of Westborough, subject to the requirements of sections two and three, inclusive, and to such additional terms and conditions as the commissioner may prescribe in consultation with the department of environmental management. Said easement shall be located within the SuAsCo watershed project and the westerly side of Mill street and is shown within Lot 21 on Assessors Map 19 and on file in the assessors office in the town of Westborough.
SECTION 2. The town of Westborough shall assume the costs of appraisals, surveys, and other expenses as deemed necessary by the commissioner for the granting of the easement described in section one.
SECTION 3. In the event that the easement described in section one is not used for the purposes stated in said section one within five years of the effective date of this act, if the town of Westborough ceases to use the easement for such purposes at any time thereafter upon notice delivered to the town of Westborough by the commissioner, or the SuAsCo reservoir dam, so-called, is abandoned or removed, said easement shall revert to the commonwealth upon such terms and conditions as the commissioner may prescribe. The granting of this easement shall not place an obligation on the commonwealth to provide water from the SuAsCo watershed project to the town of Westborough.
SECTION 4. This act shall take effect upon its passage.
