CHAPTER 10 AN ACT FURTHER REGULATING THE RECALL OF CERTAIN OFFICERS IN THE TOWN OF ARLINGTON.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Chapter 503 of the acts of 1952 is hereby amended by striking out section 38 and inserting in place thereof the following section:-

Section 38. Removal and Election. - If the petition shall be found and certified by the town clerk to be sufficient, said clerk shall submit the same with his certificate to the selectmen without delay, and said selectmen shall forthwith give written notice of the receipt of the certificate to the officer sought to be recalled and shall, if the officer does not resign within five days thereafter, thereupon order an election to be held on a Tuesday fixed by them not less than sixty nor more than seventy days after the date of the town clerk's certificate that a sufficient petition is filed; provided, however, that if any other town election is to occur within one hundred days after the date of the certificate, said selectmen shall postpone the holding of the recall election to the date of such other election. If a vacancy occurs in such office after a recall election has been ordered, the election shall nevertheless proceed as provided in this act.

SECTION 2. This act shall take effect upon its passage.
