Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, the town of Webster acting through its board of selectmen is hereby authorized to refund, without interest, sewer connection fees charged to and paid by local property owners prior to May ninth, nineteen hundred and ninety-four.

SECTION 2. All persons who have actually paid the sewer connection fee, or their spouses, shall be entitled to apply for a refund. The board of selectmen shall issue a refund to an eligible applicant hereunder provided that such application is made within ninety days after this act becomes effective in the town of Webster pursuant to section three. In the event that said ninetieth day falls on a Saturday, Sunday or legal holiday, the deadline shall be extended to include the next business day. For the purposes of this act, "filing" shall mean the physical receipt of an application by the office of the board of selectmen before the close of business on the last day for applying for such refund and an "application" shall mean any writing which is signed by the applicant which identifies the applicant, the property for which the fee was paid, and which identifies the approximate date of payment.

SECTION 3. This act shall take effect in the town of Webster upon its acceptance by the voters at the next annual town election next following the date of this act.
