CHAPTER 155 AN ACT ESTABLISHING A PERMANENT CAMPUS FOR BUNKER HILL COMMUNITY COLLEGE IN THE CITY OF CHELSEA.

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to immediately establish a permanent campus for Bunker Hill Community College in the city of Chelsea, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Item 7518-7892 in section 2 of chapter 208 of the acts of 1988, as amended by section 28 of chapter 85 of the acts of 1994, is hereby further amended by striking out the wording and inserting in place thereof the following:-

For a study and the preparation of plans and construction for a Chelsea campus for Bunker Hill Community College and related facilities, including the acquisition of land and buildings, repairs and construction, building construction, site development, parking, utility distribution systems, including the costs of furnishings and equipment; provided, however, that a sum not to exceed thirteen million five hundred thousand dollars shall be expended for a study, and the preparation of plans, and construction for an educational facility/production sound stage at said college, including the acquisition of land and buildings, repairs and construction, building construction, site development, parking, and utility distribution systems, including the costs of furnishings and equipment; provided, further, that said college is authorized to lease privately owned space in the city of Chelsea from funds authorized in this item until newly constructed or renovated facilities authorized by this item are completed and available for occupancy; provided, further, that the duration of such lease shall not exceed five years, and the cost of such lease shall not exceed five million dollars; provided, further, that said college may utilize funds authorized in this item to pay rent agreed to in a lease of space for use by said college, and to pay the purchase cost and associated acquisition costs, pursuant to an option to purchase the leased facility agreed to in said lease, exercisable by the commissioner of the division of capital planning and operations, on behalf of said college.

SECTION 2. Section 2 of chapter 472 of the acts of 1991 is hereby amended by adding the following sentence:- Notwithstanding the provisions of chapter seven of the General Laws or any other laws referred to in section three, the commissioner of the division of capital planning and operations may provide within any such leases, or amendments thereto, whether or not such leases were executed prior to the effective date of this act, for the option to purchase all or a portion of the property to be leased pursuant to this section and said section three; provided, however, that such option may not be exercised less than twelve months after initial occupancy of the leased property.

SECTION 3. Bunker Hill Community College shall make an investigation and study relative to the feasibility of establishing an evening program and satellite campus at Somerville high school in the city of Somerville, and whether such program and campus could be operational by September first, nineteen hundred and ninety-seven.
