Session Laws

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 85P> of chapter 231 of the General Laws, as appearing in the 1994 Official Edition, is hereby amended by inserting after the word "player", in line 39, the second time it appears, the following words:- , weekly player.

SECTION 2. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by striking out, in line 42, the words "four months" and inserting in place thereof the following words:- one hundred and twenty days.

SECTION 3. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by inserting after the word "increments", in line 54, the following words:- ; a weekly player means a performer who is seen and who may speak lines of dialogue and who is compensated in weekly increments.

SECTION 4. Subsection (d) of said section 85P> of said chapter 231, as so appearing, is hereby amended by inserting after the first sentence the following four sentences:- The court shall have the power to appoint a guardian of the property to oversee the child's funds. A bond shall be required for an appointment of guardianship under the provisions of this section. The guardian of the minor child shall file a bond pursuant to which the court may, in its discretion, require surety. Such guardian shall render accountings as set forth in section one of chapter two hundred and six.

SECTION 5. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by inserting after the word "consent", in line 75, the following words:- and requests.

SECTION 6. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by inserting after the word "funds", in line 77, the following words:- or, if the court finds the petitioner not suitable, the court may appoint a limited guardian. For the purposes of this section, the terms, guardian of the property and limited guardian, shall refer to the same appointed party.

SECTION 7. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by striking out, in line 88, the word "including" and inserting in place thereof the following words:- and that the petition shall include a plan for the.

SECTION 8. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by striking out, in line 90, the word "may" and inserting in place thereof the following word:- shall.

SECTION 9. Said section 85P> of said chapter 231, as so appearing, is hereby further amended by adding the following subsection:-

(g) For the purposes of subsection (f), intellectual property rights shall be defined as those rights of copyright and trademark explicitly assigned, licensed or otherwise conveyed in the contract by the child to the contracting entity. Any and all rights of privacy and rights of publicity assigned, licensed or otherwise conveyed by the child to the contracting entity shall transfer back to the child upon such revocation of approval.
