CHAPTER 443 AN ACT GRANTING THE BOARD OF SELECTMEN THE POWERS OF THE BOARD OF WATER COMMISSIONERS IN THE TOWN OF WINTHROP.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1. Section 2 of chapter 477 of the acts of 1905 is hereby amended by striking out, in lines 25 and 26, the words "water commissioners hereinafter provided for" and inserting in place thereof the following words:- selectmen of said town.

SECTION 2. Section 3 of said chapter 477 is hereby amended by striking out, in lines 7 and 8, the words "water commissioners hereinafter provided for" and inserting in place thereof the following words:- board of selectmen of said town.

SECTION 3. Section 6 of said chapter 477 is hereby amended by striking out, in lines 13 and 14, the words "water commissioners hereinafter provided for" and inserting in place thereof the following words:- board of selectmen of said town.

SECTION 4. Section 8 of said chapter 477 is hereby amended by striking out, in lines 1 and 2, the words "water commissioners hereinafter provided for" and inserting in place thereof the following words:- board of selectmen of said town.

SECTION 5. Said chapter 477 is hereby further amended by striking out section 9 and inserting in place thereof the following section:-

Section 9. All contracts made by the board of selectmen shall be made in the name of the town and no contract shall be made by said department which involves the expenditure of money not already appropriated.

The board of selectmen shall have all the powers and duties now and from time to time vested by general or special law or town by-laws in water departments.

SECTION 6. Section 13 of said chapter 477 is hereby amended by striking out, in lines 1 and 10, the words "water commissioners", each time they appear, and inserting in place thereof, in each instance, the following words:- board of selectmen of said town.

SECTION 7. Said section 13 of said chapter 477 is hereby further amended by striking out, in line 27, the word "commissioners" and inserting in place thereof the following words:- board of selectmen of said town.

SECTION 8. No contracts or liabilities in force on the effective date of this act shall be affected by the transfer of powers from the board of water commissioners to the board of selectmen pursuant to the provisions of this act. The board of selectmen shall, in all respects, be the lawful successor of the board of water commissioners.

The staff and employees of the board of water commissioners shall be assigned to the department of public works. Every employee so assigned shall continue to serve and shall retain all rights to holidays, sick leave, vacations and other benefits in effect on the effective date of this act and shall be retained in a capacity as similar to the person's former capacity as is practical.

All records, offices, property, equipment and facilities of the board of water commissioners shall be transferred to the care, custody and control of the board of selectmen on the effective date of this act.

SECTION 9. This act shall take effect upon its passage.
